A federal high court sitting in Lagos presided over by Justice Daniel Osiagor today ordered the Nigerian Police to produced one Mr Christian Ottah who has filed for the enforcement of his fundamental right before the court on the next adjourn date.
Justice Osiagor made the order while ruling on a fundamental right enforcement application filed by Mr A.B Onifade leading Akingbade Dada counsel to Mr Christian Ottah who is challenging his continuos harassment and intimidation by the police.
Joined as defendants in the fundamental Right Enforcement application are, the Inspector General of Police,the commissioner of police ( IGP monitoring unit, Lagos, Supol Ayuba Lawal, Nneka Igbonezim , Judith Igbonezim and Anthony Igbonezim
According to Fundamental Right Enforcement Application, the applicant Christian Ottah is asking for a court declaration that his continuous harassment, intimidation and humiliation is vindictive, unwarranted, abrasive, oppressive and same constitute a flagrant breach of his rights to personal liberty, dignity of human person, and right to property as respectively provided and enshrined under the African Charter on Human and Peoples right.
In the affidavit of urgency filed in support of the application, it was averred that the applicant had filed a suit for the Enforcement of his Fundamental Human Rights before the Honourable Court dated the 5th of December, 2024
That the matter has been assigned to this court and a date had been fixed for hearing which is the the 24″ of January, 2025.
That the 1st to 3rd Respondents are aware of the pendency of the suit and having been served..
That without inviting the applicant , the 1-3″ Respondents in a Gestapo manner went to arrest the Applicant’s surety , Pastor Chima Kalu Ukoha, on Sunday morning , 19″ of January, 2025 and is being detained at their office , 35 Moloney Street, Lagos Island , Lagos
That it is therefore urgent for the motion ex- parte to be heard by the Honourable Court timeously so that Pastor Chuma Kalu Ukoha can be released.
While granting the applicant’s application for urgency, Justice Osiagor further directed the police and it’s agents to produce the applicant in court on the next adjourned date.
